EB-1A Extraordinary Abilities is a top-level employment-based Green Card category, reserved for those who have demonstrated a very high level of success and achievement in their respective fields and professions. Not all EB-1A recipients have Nobel prizes, Olympic medals or Oscars awards, but the high level of success must be evident and clear.

Who is eligible for EB-1A?
  • Person of domestic or international renown with widespread recognition and accolades
  • Person who have extraordinary ability in one of the following fields: Science, Art, Education, Business, or Athletics
  • Extremely high wage earner amongst peers of same industry or profession

Basic Requirement

Applicant must satisfy
at least 3 of the below 10 criteria

  • Awards: Receipt of lesser nationally or internationally recognized prizes or awards for excellence in your field.
  • Memberships: Membership in associations in your field that require outstanding achievements of their members.
  • Published Articles Written by Others About Your Work: Published material about your work in professional or major trade publications or other major media.
  • Peer Review Activities: Evidence of your participation, either individually or on a panel, as a judge of the work of others in your field.
  • Original Contributions: Evidence of your original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field.
  • Published Scholarly Articles Written by You: Evidence of your authorship of scholarly articles in the field, in professional or major trade publications or other major media.
  • Artistic Exhibitions/Showcases: Evidence of the display of your work in the field at artistic exhibitions or showcases.
  • Critical Role: Evidence that you have performed in a leading or critical role for organizations that have a distinguished reputation.
  • Comparatively High Salary: Evidence you have commanded a high salary or other significantly high compensation for services, in relation to others in your field.
  • Commercial Success: Evidence of your commercial successes in the performing arts.

    Submission of Form I-140 to the USCIS

    All required documents and the Form I-140 (Petition for Permanent Residency) shall be submitted to the immigration department. If clients choose a premium processing channel, then the processing time could be as little as 15 working days. Otherwise, the processing time is 9-12 months.

  • Step 4

    Obtain Approval Letter

    Clients will receive an approval letter upon successful application.

  • Step 5

    Consular Processing

    Submit Consular Processing Forms and will be in line for the Immigrant Visas interview which will take 6 months on average.

  • Step 6

    Immigration Interview

    WAII will prepare you for the interview.

  • Step 7

    Obtain the Visa

    Applicants shall land in the U.S. within 6 months after obtaining the visa.

  • Step 8

    Obtain the Green Card

    The Green Card will be sent to applicants within 1-2 months;
    Applicant is eligible to apply for U.S. Citizenship after 5 years
